The recent MB case involved a dispute between an infant’s parents and his medical team about the appropriateness of continued life support. The dispute reflected uncertainty about two key factors that inform medical decision making for seriously ill infants: both the amount of pain MB experiences and the extent of his cognitive capacities are uncertain. Uncertainty of this order makes decision making in accordance with the best-interests principle very problematic. This article addresses two of the problems that cases such as (...) that of MB pose for those charged with making medical decisions for infants. First, the question of the moral significance of the interest in avoiding pain is considered. It is claimed that this interest can be outweighed by higher-order interests such as those related to autonomy but that where such higher-order interests do not exist, the interest in avoiding pain should be prioritised. Second, the question of how to proceed in cases in which the level of pain or the extent of an infant’s higher-order interests cannot be decisively established is considered. It is suggested that when genuine uncertainty over the interests of an infant exists, parental views about treatment should prevail.The English family courts recently adjudicated on another case involving conflict between parents and a medical team over the provision of life-prolonging medical treatment for an infant. At the time of the ruling, MB was an 18-month-old boy with type I spinal muscular atrophy. His life expectancy was very short , he was almost completely paralysed and he required constant ventilation. This article considers how legislators should respond to evidence that identifies a common and widely accepted parental practice as a potential source of harm to children, using domestic exposure to environmental tobacco smoke as a test case. It is claimed that children are parties to the Harm Principle, and that the State has an obligation to protect children from exposure to harm. Parental prerogative is limited by the need to avoid harming children. That said, there is considerable uncertainty about what (...) is harmful to children. Several sources of uncertainty, both empirical and conceptual, are explored, in order to demonstrate the complexity of the task legislators face. Seven considerations that are relevant to decisions about legislation of harmful parental practices are outlined, and these considerations are then employed to assess the case in favour of legislating to prohibit the exposure of children to environmental tobacco smoke in domestic settings. The present paper addresses Molnar’s problem :72–86, 2000): that of finding positive truthmakers for negative truths. The proposed solution, called, is to hold truth and falsity to be primitive and positive features of propositions and to take every literal negative truth to be made true by the falsity of the atomic proposition that it embeds. The solution is shown to be compatible with Maximalism, Necessitarianism and with the Entailment Thesis, as well as with most if not all possible variants of (...) truthmaking theory. Other advantages of are noted: it doesn’t require the inclusion of exotic objects in one’s ontology; it doesn’t require any revision of one’s logic or of one’s theory of modality. The solution also allows one to eschew negative facts, tropes and properties while providing a definition of negativity for certain literal propositions. Research into the potential associations between tinnitus and cognition has investigated specific cognitive domains in laboratory settings despite adults with tinnitus reporting broad cognitive difficulties in every-day life. To address this limitation, the present study compared performance and perceived exertion on a visual office-like task in 38 adults with tinnitus and 38 adults without tinnitus matched for age, sex and educational background. All participants were also assessed for hearing, anxiety and depression, and participants with tinnitus were also assessed for tinnitus (...) handicap. No associations were found between presence of tinnitus and cognitive performance and perceived exertion on the visual office-like task when corrected for standard and extended high frequency hearing thresholds, anxiety, and depression. The correction for extended high frequency average hearing threshold was significant for performance but not perceived exertion on the visual office-like task. Overall, the results showed extended high frequency hearing, but not tinnitus, was associated with every-day cognitive performance. This indicates clinical testing of hearing thresholds above 8 kHz could support clinicians’ identification and management of cognitive difficulties. One management method suggested by the current findings would include provision of auditory stimulation at frequencies exceeding the frequency response of many current hearing aids. (shrink)

Socrates calls this city the `true city ' and the `healthy one'. Nearly all commentators have argued that Socrates' praise of the city cannot be taken at face value, claiming that it does not represent Socrates' preferred community. He argues that perspectivism is not relativistic because it denies the dichotomy between the 'true' world and the 'seeming' world, a dichotomy central to claims to relativism. While Ramaekers' article is correct in denying relativistic interpretations of perspectivism it does not go far enough in this direction. In fact, the way Ramaekers makes his case (...) may actually encourage the charge of relativism, especially when it comes to his appropriation of perspectivism for education. This article proposes to pick up where Ramaekers left off. It will argue that Nietzsche's denial of the opposition between the 'true' world and the 'seeming' world opens up the possibility for the reestablishment of truth, albeit in a modified form. After examining Nietzsche's modified 'realist' epistemology, the paper will explore the implications of it for his philosophy of education. It will be argued that Nietzsche's educational philosophy is founded on his concept of perspectivism in so far as he demands that students be rigorously inculcated into a pedagogical framework that teaches students to discriminate between 'true' and 'false' perspectives. This framework is essential for the development of an intellectually robust and life-affirming culture. (shrink)

Quasi-set theory is a ZFU-like axiomatic set theory, which deals with two kinds of ur-elements: M-atoms, objects like the atoms of ZFU, and m-atoms, items for which the usual identity relation is not defined. One of the motivations to advance such a theory is to deal properly with collections of items like particles in non-relativistic quantum mechanics when these are understood as being non-individuals in the sense that they may be indistinguishable although identity does not apply to them. According to (...) some authors, this is the best way to understand quantum objects. The fact that identity is not defined for m-atoms raises a technical difficulty: it seems impossible to follow the usual procedures to define the cardinal of collections involving these items. In this paper we propose a definition of finite cardinals in quasi-set theory which works for collections involving m-atoms. (shrink)

Scanlon's buck-passing account of value, to be valuable is not to possess intrinsic value as a simple and unanalysable property, but rather to have other properties that provide reasons to take up an attitude in favour of their owner or against it. The 'wrong kind of reasons' objection to this view is that we may have reasons to respond for or against something without this having any bearing on its value. Resumo: A finalidade deste artigo é bastante pontual e específica: evidenciar os problemas do tratamento acrítico dado à psicologia por Brian Leiter em seu recente Moral Psychology with Nietzsche. O autor inclui, sem se empenhar em qualquer discussão metodológica, a psicologia no rol do que chama de “ciências bem-sucedidas”, tomadas como i) certificadoras do m-naturalismo nietzschiano; ii) dotadas de primazia sobre a própria filosofia na determinação do que é um “raciocínio filosófico” significativo; iii) fornecedoras de um amplo e inconteste corpo (...) de evidências de que a psicologia moral de Nietzsche “está certa” em relação a teses profundamente complexas. Minha exposição consiste em mapear a construção conceitual desse m-naturalismo, e, posteriormente, evidenciar que não há, na psicologia empírica contemporânea, nada próximo da caracterização pretendida por Leiter.: This article has a very specific purpose: to highlight the problems of Brian Leiter's uncritical treatment of psychology in his recent Moral Psychology with Nietzsche. The author includes, without engaging in any methodological discussion, psychology in the list of what he calls "successful sciences" as certifiers of Nietzschean m-naturalism; ii) as endowed with primacy over philosophy itself in determining what is meaningful "philosophical reasoning"; iii) as providing a broad and uncontested body of evidence that Nietzsche's moral psychology “is right” in profoundly complex theses. My expository strategy is to map, initially, the path taken by Leiter in the conceptual construction of his m-naturalism, and, later, to show that there is nothing in contemporary empirical psychology that legitimizes Leiter’s characterization. According to T. M. Scanlon's 'buck-passing' analysis of value, x is good means that x has properties that provide reasons to take up positive attitudes vis-à-vis x. Some authors have claimed that this idea can be traced back to Franz Brentano, who said in 1889 that the judgement that x is good is the judgement that a positive attitude to x is correct ('richtig'). The most discussed problem in the recent literature on buckpassing is known as the 'wrong kind of (...) reason' problem (the WKR problem): it seems quite possible that there is sometimes reason to favour an object although that object is not good and possibly very evil. The problem is to delineate exactly what distinguishes reasons of the right kind from reasons of the wrong kind. In this paper we offer a Brentano-style solution. We also note that one version of the WKR problem was put forward by G. E. Moore in his review of the English translation of Brentano's Vom Ursprung sittlicher Erkenntnis. Before getting to how our Brentano-style approach might offer a way out for Brentano and the buck-passers, we briefly consider and reject an interesting attempt to solve the WKR problem recently proposed by John Skorupski. Most moral philosophers who have recently expressed sympathy with feminist or ‘care-based’ perspectives on ethical theory have thought that such perspectives can make valuable contributions to more comprehensive ethical theories. Few have thought that an ethics of care can offer a complete normative theory. However, Michael Slote is one of the ambitious few. In his recent book, The Ethics of Care and Empathy, he seeks to show that a care-based perspective can do a lot of service in first-order moral and (...) political theory as well as in metaethics. Here is a quick overview of the book's content: In Chapter 1, Slote explicates the notion of empathy that is central in his ethics of care, which he locates within the sentimentalist paradigm, stemming from philosophers such as Hume and Hutcheson. Slote's account of empathy and moral development draws substantially on work by the psychologist Martin Hoffman. Chapter 2 discusses care ethics and our obligation to help others, including both the near and the distant needy. Chapter 3 aims to show how the notion of empathy can further the case for deontology in ethics. Chapters 4 through 6 discuss the relation of care ethics to pivotal issues in political philosophy, such as autonomy, liberalism, social justice and rights. Slote maintains that autonomy …. (shrink)

The circulation and entanglements of human beings, data, and goods have not necessarily and by themselves generated a universalising consciousness. The "global" and the "universal", in other words, are not the same. The idea of a world-society remains highly contested. Our times are marked by the fragmentation of a double relativistic character: the inevitable critique of Western universalism on the one hand, and resurgent identitarian and neo-nationalistic claims to identity on the other. Sources of an argumentation for a strong universalism (...) brought forward by Western traditions such as Christianity, Marxism, and Liberalism have largely lost their legitimation. All the while, manifold and situated narratives of a common world that re-address the universal are under way of being produced and gain significance. This volume tracks the development and relevance of such cultural and social practices that posit forms of what we call minor universality. Context: The majority of contemporary enactivist work is influenced by the philosophical biology of Hans Jonas. Jonas credits all living organisms with experience that involves particular “existential” structures: nascent forms of concern for self-preservation and desire for objects and outcomes that promote well-being. We argue that Jonas’s attitude towards living systems involves a problematic anthropomorphism that threatens to place enactivism at odds with cognitive science, and undermine its legitimate aims to become a new paradigm for scientific investigation (...) and understanding of the mind. Problem: Enactivism needs to address the tension between its Jonasian influences and its aspirations to become a new paradigm for cognitive science. By relying on Jonasian phenomenology, contemporary enactivism obscures alternative ways in which phenomenology can be more smoothly integrated with cognitive science. Method: We outline the historical relationship between enactivism and phenomenology, and explain why anthropomorphism is problematic for a research program that aspires to become a new paradigm for cognitive science. We examine the roots of Jonas’s existential interpretation of biological facts, and describe how and why Jonas himself understood his project as founded on an anthropomorphic assumption that is incompatible with a crucial methodological assumption of scientific enquiry: the prohibition of unexplained natural purposes. We describe the way in which phenomenology can be integrated into Maturana’s autopoietic theory, and use this as an example of how an alternative, non-anthropomorphic science of the biological roots of cognition might proceed. Results: Our analysis reveals a crucial tension between Jonas’s influence on enactivism and enactivism’s paradigmatic aspirations. This suggests the possibility of, and need to investigate, other ways of integrating phenomenology with cognitive science that do not succumb to this tension. Implications: In light of this, enactivists should either eliminate the Jonasian inference from properties of our human experience to properties of the experience of all living organisms, or articulate an alternative conception of scientific enquiry that can tolerate the anthropomorphism this inference entails. The Maturanian view we present in the article’s final section constitutes a possible framework within which enactivist tools and concepts can be used to understand cognition and phenomenology, and that does not involve a problematic anthropomorphism. Constructivist content: Any constructivist approach that aims for integration with current scientific practice must either avoid the type of anthropomorphic inference on which Jonas bases his work, or specify a new conception of scientific enquiry that renders anthropomorphism unproblematic. In this paper, I explore Martin Heidegger’s and Herbert Marcuse’s critiques of technology, and their suggestions on how to neutralise the negative effects of technology, in order to articulate a potential path to an authentic, unalienated life. Martin Heidegger’s view of technology and its negative effects are first explored before presenting Marcuse’s critique of Heidegger. The dissimilarities between Heidegger’s ‘Gestell’ and Marcuse’s ‘Technological Rationality’ are then explored, before then examining the differences between Heidegger’s and Marcuse’s ideas of how one may (...) overcome the alienating impact of technology. Favouring Marcuse’s suggestions, Hans Jonas’ work on technological ethics is then posited as a necessary guide for Marcuse’s vision of a post-alienated existence. I conclude that the continued appropriation and integration of Heideggerian thought into critiques of technology could be valuable for the field, especially when answering questions concerning individual authenticity in the context of rapid technological progress and ecological decline. Uncertainty replaces the conviction that rationality may be founded, ultimately. Comments on and exemplified by Zygmunt Bauman's "Intimations of postmodernity" (1992), the Quality-of-life discussion (Nussbaum & Senn (eds.) 1993) and "reflexive modernization" (Ulrich Beck, 1994). Uncertainty as a principle leads to the "imperative of responsibility" (Hans Jonas, 1984).

Open peer commentary on the article “Homeostats for the 21st Century? Simulating Ashby Simulating the Brain” by Stefano Franchi. Upshot: The target article proposes that Ashby’s investigations of the homeostat and ultrastability lead to a view of living systems as heteronomous, passive “sleeping” machines and thus are in fundamental conflict with concepts of autonomy developed by Jonas, Varela and others. I disagree, arguing that (1) the maintenance of essential variables within viability limits is not a passive process for living (...) systems and (2) the purpose of Ashby’s investigations of the homeostat was to investigate adaptivity, a subject that is related to, but clearly distinct from, autonomy. As such, I find Ashby’s work on adaptivity to be neither in opposition to nor in direct support of modern concepts of biological autonomy and suggest that a productive way forward involves the investigation of the intersection between these two fundamental properties of living systems. This study argues that the bond between ‘secularization’ and ‘de-legitimation’ is not only borne out in debates over grand historical narratives relating to the status of modernity, as argued by Hans Blumenberg, but in debates over the appraisal of specific modern philosophical programs as well. It does this by examining how the category of ‘secularization' is used to delegitimize Martin Heidegger's thought, from both theological and secular perspectives, by two of his former students, Hans Jonas and Karl Löwith. By (...) analysing their interpretation of Heidegger and their understanding of secularization, legitimacy, and the philosophy-theology relationship, this study sheds light on the intellectual projects of these three thinkers – master and two students – and demonstrates the application of secularization as a hermeneutical category of de-legitimization on the basis of ‘insufficiency’ – either insufficiently secular or insufficiently religious.
